What is an AST (Assured Shorthold Tenancy) agreement?

The majority of new tenancies are automatically Assured Shorthold Tenancies. When an AST has been agreed, the Landlord has the right to repossess the property at the end of the initial term.


A tenancy can be an AST if all of the following conditions apply:

  1. You are a private landlord.
  2. The Tenant is an individual.
  3. The property is the main accommodation of the Tenant.
  4. The Landlord lives elsewhere.
  5. The tenancy began on or after the 15th January 1989.

When can a tenancy not be an AST?

  1. The annual rent is more than £100,000.
  2. The annual rent is less than £1000 in London or £250 elsewhere.
  3. It is a business tenancy or a tenancy of licenced premises.
  4. The landlord is a local authority or housing association.
  5. If the property has more than 2 acres of agricultural land (or garden).
  6. It is a holiday letting.
  7. If the property will not be the tenant’s only or primary home.
  8. The tenancy was agreed before 15 January 1989.
