What is an AST (Assured Shorthold Tenancy) agreement?

ASTs are the most common type of agreement used between landlords and private tenants. An AST grants landlords the right to repossess the property after the agreed letting term is over. This is not the case with other forms of tenancy.

A tenancy can be an AST if all of the following conditions apply:

  1. You are a private landlord.
  2. The Tenant is an individual.
  3. The property is the Tenant’s main accommodation.
  4. The Landlord lives elsewhere.
  5. The tenancy began on or after the 15th January 1989.

When can a tenancy not be an AST?

If a property meets any of the following criteria, the property is not eligible to be considered as an Assured Shorthold Tenancy:

  1. The annual rent is more than £100,000.
  2. The annual rent is less than £1000 in London or £250 elsewhere.
  3. It is a business tenancy or a tenancy of licenced premises.
  4. The landlord is a local authority or housing association.
  5. If the property has more than 2 acres of agricultural land (or garden).
  6. It is a holiday letting.
  7. If the property will not be the tenant’s only or primary home.
  8. The tenancy was agreed before 15 January 1989.
