What is an Assured Shorthold Tenancy agreement?

ASTs are the most common form of tenancy and automatically form the majority of new tenancies. Certain conditions must be met, but with an AST, a Landlord has the guaranteed right to repossess their property at the end of the rental term.


The requirements for AST agreements are provided by The Housing Act 1988, as amended by The Housing Act 1996.


A tenancy can be an AST if all of the following conditions apply:

  1. You are a private landlord.
  2. The Tenant is an individual.
  3. The property is the main accommodation of the Tenant.
  4. The Landlord lives elsewhere.
  5. The tenancy began on or after 15th January 1989.

When can a tenancy not be an AST?

  1. The annual rent is more than £100,000.
  2. The annual rent is less than £1000 in London or £250 elsewhere.
  3. It is a business tenancy or a tenancy of licenced premises.
  4. The landlord is a local authority or housing association.
  5. If the property has more than 2 acres of agricultural land (or garden).
  6. It is a holiday letting.
  7. If the property will not be the tenant’s only or primary home.
  8. The tenancy was agreed before 15 January 1989.
